HB 434 NO PAY NO PLAY
Louisiana’s updated “No Pay, No Play” statute raises the recovery threshold for uninsured drivers from $15,000 to $100,000 for bodily injury and from $25,000 to $100,000 for property damage. This means that uninsured drivers involved in a motor vehicle accident cannot recover the first $100,000 in damages, regardless of fault.
HB 450 HOUSLEY PRESUMPTION
Eliminates the “Housley Presumption,” a judicial rule that assumes an injury is caused by an accident, not before or after the accident. By requiring plaintiffs to provide medical evidence that directly links their injuries to the accident, this will reduce frivolous lawsuits and ensure that only legitimate claims receive compensation.
SB 231 MEDICAL TRANSPARENCY/COLLATERAL SOURCE
Revises Louisiana’s collateral source rules to align more closely with those of Texas. The law means plaintiffs can only recover the actual amounts paid for medical services, rather than the inflated billed amounts. This reform aims to increase transparency in medical billing, prevent inflated claims, and contribute to the reduction of excessive insurance payouts.
HB 436 ILLEGAL ALIENS
Prevents undocumented immigrants who are injured in a car accident from collecting general damages.
HB 431 COMPARATIVE FAULT
Modifies Louisiana’s comparative fault rules to bar recovery if a plaintiff’s fault is 51% or more, and otherwise reduces damages in proportion to their fault, with jury instructions required.
HB 549 DASH CAM DISCOUNT
Requires insurance companies to offer premium discounts to commercial truck drivers who install and utilize operational dashboard cameras to provide clear evidence in the event of accidents, discourage fraudulent claims, and promote safer driving practices, ultimately benefiting both insurers and policyholders.
HB 519 DISTRACTED DRIVING
Prohibits the use of social media and texting while driving in Louisiana. By addressing distracted driving, this law intends to reduce the number of preventable accidents, enhance road safety, and potentially lower insurance costs associated with such incidents.
HB 496 TIME LAPSE PENALTY
Prohibits insurers from raising auto insurance rates or adding surcharges for a driver’s first lapse in coverage, allows increases for repeated lapses, and ensures that insurers cannot deny coverage or require switching providers solely due to a lapse.
HB 258 PREMIUM INCREASES
Prohibits automobile insurers from increasing premiums solely on the basis that the insured has reached the age of sixty-five.
HB 291 PRESCRIPTIVE PERIOD
Increases the prescriptive period for wrongful death and survival actions to 2 years.
HB 499 PENALTY INCREASES
Increases monetary penalties for speeding or breaching a construction zone or utility work safety zone.
HB 85 IRC CODE
Requires municipalities and parishes that issues construction permits to inspect all buildings, and including one- and two-family dwellings, for roof construction and reroofing in compliance with the IRC Code.
HB 121 PUBLIC ADJUSTERS
Prohibits public adjusters from acting as a contractor or subcontractor in connection with a claim that the adjuster has processed.
HB 122 ROOF REGISTRY
Creates the Louisiana Roof Registry.
HB 145 RETROFITTING EXISTING STRUCTURES
Increases the allowable tax deduction for the voluntary retrofitting of an existing residential structure.
HB 329 UNAUTHORIZED INSURERS
Requires that Department of Insurance credit the first $5 million of taxes collected from surplus and unauthorized insurance insurers into the Louisiana Fortify Homes Program Fund.
HB 345 EXTENDS NOTICE PERIOD
Extends the notice period for a residential policyholder to receive notice of a policy cancellation to 60 days.
HB 356 STATED VALUE POLICY
Requires property and casualty insurers to offer a “stated value” homeowner’s policy to consumers.
SB 52 INDIVIDUAL INCOME TAX EXPEMTION
Authorizes an individual income tax exemption for the grant amount received from the Louisiana Fortify Homes Program on or after January 1, 2025.
SB 28 INCOME TAX CREDIT
Establishes an income tax credit for taxpayers who pay to install a fortified roof on their property.
HB 148 INSURANCE COMMISSIONER AUTHORITY
Enhances the powers of the Louisiana Commissioner of Insurance, granting the authority to reject excessive rate hikes and improve transparency within the insurance industry. The objective is to provide more robust oversight, ensuring that insurance companies operate fairly and that consumers are protected from unjustified premium increases.
HB 401 UNEXPECTED MONIES
Requires that unexpended monies remain in the Insurance Fraud Investigation Dedicated Fund Account at the end of fiscal year, rather than being returned to insurers.
HB 438 PROHIBITS INSURANCE RATES BASED ON ADVERTISING
Prohibits insurance companies from using advertising costs to set insurance rates.
HB 635 REWORKS STANDARDS FOR CHOICES
Renames the existing Louisiana Captive Insurers Law to the “Creating Holistic Options in Coverage for Enterprise and Self-Insurance (CHOICES) Law,” and reworks regulations pertaining to the creation of, regulations for, and standards for captive insurance companies operating within Louisiana.
SB 40 MODIFIES TRAINING REQUIREMENTS
Modifies the annual training requirements for certain insurance producers and consultants, and requires annual training relating to recent legislative updates in insurance law.
SB 61 NOTIFYING CONSUMERS
Requires insurance companies to notify consumers on how they may obtain a copy of credit information used in the underwriting or rating process.
SB 136 RATE TRANSPARENCY REPORT
Requires that all homeowners or automobile insurers file a rate transparency report with the Department of Insurance, based on the most recently approved rate filing, by January 1 of each year.
SB 137 WRITTEN NOTICE OF COVERAGE
Requires that automobile and property insurers give the Insurance Commissioner written notice of the decision to cease, pause, or resume writing coverage for a particular zip code or region of the State.
